2. Ordering From Us

You place an order with us by completing our online checkout process. During checkout, you will have an opportunity to check your order and correct any errors. We will send you an order acknowledgement detailing the products you have ordered.

Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. The purchase contract will be formed when the order is dispatched, even if payment has been processed earlier, unless we have notified you that we do not accept your order or you have cancelled it.

We may refuse to accept an order:

  1. Where the goods are not available.
  2. Where we cannot obtain authorisation for your payment.
  3. If there has been a pricing or product-description error.
  4. If you do not meet any eligibility criteria set out in these Terms and Conditions.

Some parts may be dispatched directly by our suppliers to improve delivery speed and product availability. We may therefore ask you to return a product directly to the supplier or warehouse that dispatched it. We will deal with all approved refunds directly with you.

Shortages, Damage and Incorrect Parts

Shortages, damage or incorrectly supplied parts must be reported to us in writing within 48 hours of receipt. Failure to notify us within 48 hours may be treated as confirmation that the complete order was received, subject always to any rights that cannot lawfully be excluded.

We reserve the right to request additional information to verify the business status of any customer. We may refuse, cancel or suspend an order where we reasonably believe that the purchase is not being made for business or trade purposes.

Where a customer provides inaccurate, incomplete or misleading information regarding their business status, the Company shall not be responsible for any resulting loss, claim, cost or liability arising from reasonable reliance upon that information.

It is the Buyer’s responsibility to order the correct part. The Seller will supply the part ordered and accepts no responsibility for inaccurate advice supplied to the Buyer by a third party when identifying or diagnosing the required part.

4.1 Drawings and Specifications

The goods supplied are manufactured by different manufacturers and are made in accordance with their respective specifications and designs. Subject to the provisions of these Terms and Conditions, Allied Plumbing & Heating Ltd cannot accept responsibility for loss or inconvenience caused by a manufacturer’s design or manufacturing defect.

Compatible copy parts will be supplied as shown in the relevant product images. Many will not include washers, gaskets or instructions unless stated otherwise. If you require an original manufacturer part, please email us for a quotation before ordering.

Subject to Clause 9.1, we shall not be liable for work undertaken by the Buyer or a third party in connection with an allegedly defective compatible part, whether the claim arises directly, indirectly or consequentially.

4.3 OEM, Genuine and Original Manufacturer Products

Where products are described as OEM, genuine, original manufacturer or manufacturer-supplied products, Allied Plumbing & Heating Ltd does not manufacture those products and relies upon the specifications, descriptions, warranties and information supplied by the relevant manufacturer.

Any warranty claim relating to an OEM, genuine or original manufacturer product will be subject to the warranty procedures and limitations contained in Clauses 8.2 to 8.7 of these Terms and Conditions.

Subject to Clause 9.1, Allied Plumbing & Heating Ltd shall not be liable for labour costs, installation costs, removal costs, reinstallation costs, call-out charges, property damage, consequential losses, indirect losses or other expenses arising from an alleged defect, malfunction or failure of an OEM, genuine or original manufacturer product.

8.2 Parts Warranty

All parts supplied by Allied Plumbing & Heating Ltd come with a six-month warranty unless otherwise stated. The applicable warranty will be the warranty specified by the relevant manufacturer.

A product found to be defective within the applicable warranty period will, at the Company’s discretion, be repaired or replaced with an equivalent product, subject to the purchaser providing reasonable evidence of purchase and information reasonably required to assess the claim.

No credit, refund or compensation will be issued unless expressly agreed in writing by the Company.

Subject to Clause 9.1, Allied Plumbing & Heating Ltd shall not be responsible for loss, damage, expense or liability arising from the faulty nature, failure, use or installation of a product.

The Company shall not be liable for labour charges, installation costs, removal costs, reinstallation costs, engineer attendance charges, call-out charges or work carried out by the purchaser or a third party in connection with defective goods. All warranty claims are subject to Clauses 8.3 to 8.7.

8.3 Product Inspection and Warranty Claims

An alleged defect must be reported to the Company in writing immediately upon discovery and within the applicable warranty period.

The Company reserves the right to require the return of an allegedly defective product for inspection and testing by the Company, the manufacturer or an appointed third party.

The purchaser shall initially bear the cost of returning the product for inspection. If the product is verified by the manufacturer or the Company as genuinely defective, the Company will reimburse reasonable standard carriage costs.

No warranty claim will be accepted unless the product is made available for inspection. The purchaser must not dispose of, alter, repair, dismantle or modify the product before the inspection has been completed.

The Company reserves the right to reject a warranty claim where the product has not been made available for inspection or the purchaser has failed to provide reasonable supporting evidence.

8.4 Exclusive Remedy

Where a product is found to be defective within the applicable warranty period, the purchaser’s sole and exclusive remedy will be the repair or replacement of the product at the Company’s discretion.

No refund, compensation, damages, reimbursement, labour costs, consequential losses, indirect losses or other remedy will be available unless expressly agreed in writing by the Company, subject always to Clause 9.1.

8.5 Installation, Suitability and Use

The purchaser is solely responsible for ensuring that the product is suitable for its intended application and is installed, commissioned, operated, serviced and maintained by an appropriately qualified and competent professional.

Where required by law, work must be undertaken by an appropriately registered professional, including an active Gas Safe registered engineer where applicable.

The Company accepts no liability for loss, damage, cost or expense arising from incorrect installation, incorrect commissioning, misuse, abuse, neglect, modification, improper maintenance, freezing, contamination, excessive pressure, electrical faults, system defects, incompatibility with existing equipment, failure to follow manufacturer instructions or another cause beyond the Company’s reasonable control.

8.6 Exclusion of Property Damage Claims

Subject to Clause 9.1 and to the fullest extent permitted by law, the Company shall not be liable for damage to property, buildings, fixtures, fittings, boilers, heating systems, hot-water systems, pipework, ceilings, walls, floors, decorations, equipment, stock or other property arising directly or indirectly from the installation, use, malfunction, failure or alleged failure of a product supplied.
